Collect a Debt from a Company in the United Kingdom

Updated 2026-10-24

To collect from a UK company, begin with amicable collection through a UK-based partner: Companies House checks, a formal demand, and calls to the director or finance lead. Many UK debtors pay once a firm letter before action arrives. If not, a solicitor can sue in England and Wales, Scotland or Northern Ireland, or bring a common-law action on an existing U.S. judgment. Confirm options with UK counsel.

Why UK collections move quickly when the paperwork is clean

UK companies file accounts and director details at Companies House, so we can confirm the debtor's registered number, current directors and whether it is in administration, liquidation or a voluntary arrangement before we make the first call. That saves time and avoids chasing a company that has already entered insolvency.

UK courts and debtors expect a structured approach. A clear letter before action that sets out the debt, attaches invoices and gives a deadline is standard practice, and courts look at whether parties behaved reasonably before litigation. A well-prepared demand often prompts payment because the debtor knows the creditor is ready to take the next step.

How a UK file is handled

  • Confirm the legal entity and registered office at Companies House
  • Check the Gazette and insolvency registers for winding-up petitions or administrations
  • Send a formal demand and letter before action through a UK partner
  • Call the finance contact and, where useful, a director
  • Negotiate payment in full or a written plan, with settlements sent to you for approval
  • Recommend legal action, with cost estimates, only when the debtor can pay

Legal routes in the UK

A UK solicitor can issue a claim in the courts of the part of the UK where the debtor is based. England and Wales, Scotland and Northern Ireland each have their own procedures. Undefended money claims can lead to a default judgment, which can then be enforced through methods such as enforcement agents, third-party debt orders against bank accounts or charging orders over property.

If you hold a U.S. judgment, the UK has no treaty with the United States for registering it. Instead, the usual approach is a common-law action on the judgment, treating it as a debt. If the U.S. judgment is final, for a fixed sum and from a court the UK recognizes as having jurisdiction over the debtor, the claimant can often seek summary judgment. The debtor may still raise defenses such as fraud, breach of natural justice or public policy, and UK law will not enforce multiple or punitive damages awards. Jurisdiction is often the deciding issue, so check it with a solicitor before relying on a U.S. judgment.

Statutory demands and winding-up petitions are also available against companies in some situations, but they are serious steps that should only follow legal advice.

Late payment interest and compensation

UK law gives businesses a statutory right to interest and fixed compensation on late commercial payments, under the Late Payment of Commercial Debts (Interest) Act 1998. Whether a U.S. creditor can claim it depends on the law governing your contract. As a rule it applies where the contract is governed by the law of part of the UK, so check your terms and conditions before adding it to a demand. A UK solicitor can confirm whether it applies to your file.

Documents that help

  • Signed terms and conditions, including any governing-law clause
  • Purchase orders and invoices in the amount claimed
  • Proof of delivery or completion of services
  • Correspondence acknowledging the debt or raising no dispute
  • Any U.S. judgment, plus proof of how the debtor was served

Frequently asked questions

Can I register a U.S. judgment in England?

No treaty registration route exists for U.S. judgments. The usual approach is a new common-law claim on the judgment, often decided by summary judgment if the U.S. court had jurisdiction recognized by English law. A UK solicitor should review the file first.

Can a U.S. creditor claim UK late payment interest?

Possibly. The Late Payment of Commercial Debts (Interest) Act 1998 generally applies where the contract is governed by UK law. If your contract is governed by a U.S. state's law, your remedies for late payment come from that law and the contract instead.

What if the UK company has gone into liquidation?

Collection activity stops and you file a claim with the insolvency practitioner. We check Companies House and the Gazette before starting work so you know early if this applies.

How much does it cost?

Amicable collection is on contingency, so you pay only a share of what is recovered. Solicitor fees and court costs are quoted to you in advance and need your approval.
